Fines Ryanair and Wizz Air for carry-on baggage policy

The Italian competition authority AGCM has imposed substantial fines on both Ryanair and Wizz Air for charging mark-ups on large carry-on baggage. According to the Authority, this is in breach of the transportation conditions. Ryanair was fined €3,000,000 and Wizz Air was fined € 1,000,000.

Investigation of baggage policy Ryanair and Wizz Air

Late last year, the competition authority announced they would start an investigation into Ryanair’s and Wizz Air’s new carry-on policy. This policy sets out that passengers pay an extra charge for carrying on larger pieces, including spinner cases. Only a small bag or laptop bag may be carried into the plane free of charge.

This policy is in breach of the transportation contract.

The airlines implemented the new carry-on policy not only for passengers buying a ticket after the effective date of the new carry-on rules, but also for passengers who booked a flight ticket with one of the two above airlines before the effective date to fly after the effective date. According to the Italian Authority, this is in breach of legislation. Additionally, carrying on hand baggage (irrespective of size) is part of the transportation agreement and the airlines have an obligation to include such charges in the ticket price.

Misleading passengers

The competition watchdog is of the opinion that the charges, ranging from € 5 to € 25, are misleading with regard to the actual ticket price, as this is not the price shown at the start of the booking process. This can make it difficult for passengers to compare prices with other airlines that do include this in their prices.

Appeal against the decision of the competition authority

Both airlines must suspend their policy of extra charges for larger carry-on pieces. Both Ryanair and Wizz Air may appeal this decision in court.
