Belgian retailer Elektro Lommelen bankrupt: what can you do?
The Belgian company Elektro Lommelen, which sold electronic products for many years, has run into financial trouble. Unfortunately, many customers are no longer getting responses to their complaints. Since the end of June, Elektro Lommelen has also stopped communicating with the European Consumer Centre (ECC). The website has been taken offline, and the Facebook account has been removed. The company’s bankruptcy has now been confirmed.
What does this mean for you as a customer of Elektro Lommelen?
Did you order a product from Elektro Lommelen and still haven’t received it? Or are you waiting for a refund? This is of course very frustrating. But luckily, there are still some steps you can take.
1. Submit a claim via Regsol
You can file your claim in Belgium using the digital platform Regsol (www.regsol.be), which is specially set up for bankruptcies. This is the fastest way to submit your claim if Elektro Lommelen still owes you money. You should do this within 30 days of the company being declared bankrupt. Here's how to submit a claim:
- Create a profile on Regsol
- Choose the option 'Foreign natural person' if you are not a Belgian citizen
- Attach all the necessary evidence, such as proof of purchase and payment
2. Contact the insolvency administrator
If you cannot submit a claim through Regsol, you can also file your claim directly with the insolvency administrator handling the Elektro Lommelen bankruptcy. You can use our template letter for this. The contact details of the administrator are:
- MC2 Advocaten t.a.v. mevrouw Orlent, Prinses Josephine-Charlottelaan 71 - 9100 Sint-Niklaas – België, @email
Make sure you also include the required documents to support your claim.
3. Claim your money back through your credit card company or PayPal
Did you pay Elektro Lommelen using a credit card or via PayPal? Then file a claim through these payment methods. They may be able to help you get your money back. Unfortunately, most customers paid by bank transfer, which makes this option less useful for many consumers.
No further cooperation with the company
Elektro Lommelen was previously willing to resolve complaints through mediation. The European Consumer Centre (ECC) Belgium worked closely with the company to find solutions. But since the end of June, Elektro Lommelen has stopped responding to mediation requests. Mediation is only possible if the seller cooperates with the ECC. Without this cooperation, ECC Belgium is unable to take further steps.
Act quickly
Do you have a claim against Elektro Lommelen? Then don’t wait too long to take action. The Belgian authorities and consumer watchdogs are aware of the situation. But you must submit your claim on time via Regsol or directly to the insolvency administrator. On Regsol, you must file your claim within 30 days of the company being declared bankrupt.
ESCP/EPO procedure no longer an option
Did you recently start the European Small Claims Procedure (ESCP) or the European Payment Order (EPO) and received a judgement? Then you must also inform the insolvency administrator about this.
Were you planning to start a procedure against Elektro Lommelen? Unfortunately, these procedures are no longer an option now that the company has been declared bankrupt. Instead, contact the insolvency administrator.
