Termination of purchase contract misleading information

Geachte heer, mevrouw,

Op <datum> kocht ik <online> bij u, een <naam product> voor het aankoopbedrag van € <vul hier het totaalbedrag in>. Dit product ontving ik op <datum>. Middels dit schrijven maak ik de aankoop ongedaan.

Reden ontbinding overeenkomst
Deze aankoop heb ik gedaan op basis van misleidende informatie. Volgens uw informatie zou ik een product krijgen dat <leg uit waar het product volgens de verkoper aan zou moeten voldoen>. Het product voldoet niet aan die omschrijving. Als u mij vooraf goed had geïnformeerd, dan had ik de overeenkomst niet met u gesloten.

Wet Oneerlijke Handelspraktijken 
Ondernemers zijn verplicht om consumenten eerlijk te informeren. De consument mag niet misleid worden. Dat staat in de Wet Oneerlijke Handelspraktijken. Wordt de overeenkomst gesloten op basis van een oneerlijke handelspraktijk? Dan mag de consument de overeenkomst vernietigen.

Verzoek bevestiging ontbinding overeenkomst
Ik verzoek u vriendelijk om het bedrag € <vul hier het bedrag van de aanbetaling in> binnen de termijn van 30 dagen over te maken naar bankrekening: <noteer uw IBAN rekeningnummer> t.n.v. <noteer naam rekeninghouder> o.v.v. “Koopovereenkomst vernietigen”.

(Juridische) vervolgstappen
Als ik binnen de gestelde termijn van 30 dagen geen bevestiging van de ontbinding van de overeenkomst <indien van toepassing: en terugbetaling> ontvang, dan meld ik dit bij ACM ConsuWijzer. <Optioneel: ‘Ook dien ik een klacht in bij het Europees Consumenten Centrum’>. Mocht dit niet tot een oplossing leiden, zal ik de zaak voorleggen aan de Geschillencommissie of rechter. De kosten hiervan komen voor uw rekening. Ik vertrouw erop dat het niet zo ver hoeft te komen.

Ik ga ervan uit u hiermee voldoende te hebben geïnformeerd en blijf in afwachting van uw reactie.

On <date>, I made an <online> purchase from your company ‘<name of company>’, a <name of product> for the sum of € <enter the total amount here>. I hereby cancel the purchase agreement.

Termination of the purchase contract
This purchase is made based on misleading information. According to the sales description, I would get a product that <explain what was promised in the sales description>, the product I received does not meet that description.

Unfair Commercial Practices
The seller is obliged to inform consumers fairly. The consumer may not be misled pursuant to legislation. If the consumer concludes a purchase contract based on unfair commercial practices, he can terminate the agreement.

Confirmation of termination of the contract 
I herewith request you to refund the purchase sum of € <enter the total amount> within 30 days to my account number <enter your IBAN account number>, account holder <name account holder> with payment reference ‘termination of purchase contract <order number>’.

Further steps
If I do not receive a response from you within the above period of 30 days, I will submit a complaint to the European Consumer Centre. I will also forward the complaint to the Supervisory Body, the Netherlands Consumer and Market Authority (ACM). If this does not result in a solution, I will submit the issue to the disputes committee or the Court. The expenses involved will be charged to you. I hope we can settle this matter without recourse to such measures.
